Chapter 5 — A Family Agreement Before the Will Is Opened

A family can reduce the risk of a damaging inheritance dispute before anyone knows what the will says.

The purpose is not to predict an argument or pressure anyone to accept an unfair outcome. It is to agree, while everyone is still on relatively equal ground, how questions and disagreements will be handled if they arise.

One sensible principle is that the family will first exchange information, then speak to one another and, if necessary, attempt independent mediation before beginning hostile court proceedings.

That agreement cannot remove anybody's legal rights. It can, however, change the way the family approaches a problem and make expensive litigation less likely.

There is usually no formal reading of the will

Films and television programmes often show a solicitor gathering the family together and reading the will aloud. That is not the normal probate process in England and Wales.

The executors usually locate the original will, confirm that it appears to be the latest version and begin dealing with the estate. Beneficiaries may then be told what the will provides for them.

Once a grant of probate has been issued, the will normally becomes a public document. Before then, the position is more limited and the original will must be protected.

The family meeting described in this chapter is therefore not a ceremonial reading. It is an early discussion about behaviour, communication and the way any future dispute will be managed.

Why agree before the contents are known?

Once people know what they have or have not inherited, their positions may harden quickly.

A person who feels disappointed may suspect pressure, favouritism or wrongdoing. A beneficiary receiving a larger share may feel attacked and become defensive. Old family grievances can become mixed with legal questions about the will.

Before the contents are known, nobody is being asked to surrender a particular claim. The family is agreeing only to a fair process for dealing with concerns.

The meeting should not become an opportunity to accuse people in advance. Its purpose is to prevent suspicion from controlling what happens next.

Who should take part?

The appropriate participants will depend on the family.

The discussion may include the executors, the closest relatives and anyone who is reasonably likely to be directly affected by the administration.

It does not have to include distant relatives or everyone who believes they might receive something. A very large meeting may be unmanageable and may disclose private information unnecessarily.

Nobody should be misled into thinking that attendance gives them a right to inherit.

If family members cannot safely or calmly meet in person, the agreement can be discussed by video call, through a neutral person or in separate conversations before being circulated in writing.

Reasonable arrangements should be made for anyone who needs an interpreter, communication support or more time to understand what is being proposed.

Choose a neutral chair

One person should guide the discussion and keep it focused.

The chair might be a trusted family friend, an experienced executor, a community or faith representative, or another person accepted as neutral.

The chair should not decide who is right, interpret the will or pressure anyone to agree. Their role is to make sure each person can speak, the discussion remains respectful and the agreed points are recorded accurately.

Where conflict is already serious, use a qualified independent mediator rather than asking a relative to manage the meeting.

What the family should agree

The agreement should be short and realistic. It may cover the following principles:

The agreement should not attempt to decide how the estate will be distributed. That is governed by the valid will, the intestacy rules and any lawful agreement or court order made later.

Suggested family agreement

The following wording can be adapted to the circumstances:

> We agree that if any disagreement arises over the will or the estate, we will not rush into hostile legal proceedings. We will first preserve the estate and relevant documents, share information that can properly be disclosed and meet to discuss the problem. If we cannot resolve it ourselves, we will attempt independent mediation before considering court action. Nothing in this agreement prevents any person from obtaining independent legal advice or taking urgent steps needed to protect the estate or their legal position.

This is an agreement in principle. It may carry moral and practical weight, but families should not present it as a guaranteed legal bar to a later claim.

If the family wants a binding agreement dealing with legal rights, each affected person should obtain independent legal advice and the document should be prepared properly.

Record the agreement

Write down the agreed principles immediately after the meeting.

Circulate the same version to everyone who took part and allow corrections where the record is inaccurate.

Those who agree can sign and date it, although the purpose at this stage is to record a shared intention rather than create a complicated legal contract.

Keep the document with the estate records.

The record should also identify:

Do not secretly record a family meeting. If a recording is considered necessary, obtain the informed agreement of everyone involved and decide how it will be stored and used.

Agree how information will be shared

Silence creates suspicion. Constant messages from several relatives create confusion.

The family should agree on one sensible communication route. This might be a shared email chain, a private family group or written updates from the executor.

Updates should be factual. They may explain:

The person providing updates should not disclose confidential personal, financial or legal information merely to satisfy curiosity.

Beneficiaries are entitled to appropriate information, but the amount and timing may depend on their interest in the estate and the stage of the administration.

Where disclosure is disputed, the executor should obtain advice rather than allowing the argument to grow through inconsistent messages.

Preserve the estate while questions are unresolved

The family agreement should make clear that disagreement is not permission to take possession of estate assets.

Nobody should remove cash, jewellery, documents, furniture, vehicles or sentimental belongings simply because they fear somebody else will take them first.

If items have already been removed for safekeeping, they should be declared, photographed and recorded, with their location and custodian identified.

The property should be secured and an inventory started. Important digital information, messages and financial records should also be preserved.

Destroying, hiding or altering evidence can make a dispute more serious and may have legal consequences.

What mediation involves

Mediation is a structured and usually confidential process in which an independent mediator helps the parties explore whether they can reach an agreement.

The mediator does not act as a judge and does not impose a decision.

Each person can explain their concerns, hear the other positions and consider practical solutions that a court might not order.

The mediator should disclose any connection with the family or its advisers.

The parties should agree how the mediation fee will initially be paid. Agreement to share that cost does not necessarily decide who ultimately bears legal or estate costs.

Mediation and solicitors are not opposites

Encouraging mediation does not mean that nobody should speak to a solicitor.

Independent legal advice can help a person understand whether a concern has a proper legal basis, what evidence is needed and what a reasonable settlement might look like.

A solicitor can advise privately without sending an aggressive letter or beginning court proceedings.

Legal advisers can also help prepare for mediation and turn an agreement into a valid settlement.

The aim is to use legal advice to clarify and resolve the problem, not to inflame it unnecessarily.

When urgent action may be necessary

Mediation should normally be attempted before hostile litigation, but it cannot always come first.

A caveat or court application may sometimes be needed to preserve the position while the parties consider mediation.

Taking urgent protective action does not prevent a mediated settlement later.

Avoid making promises about the outcome

At the early meeting, nobody should promise that a disappointed relative will receive money or a particular possession.

The validity and meaning of the will have not yet been established. Debts, tax and expenses may also affect what is available.

Likewise, nobody should be told that they have “no rights” merely because their name is not expected to appear in the will.

Some people may have a possible claim against the estate, but that depends on the facts and the law. It should not be decided through family pressure or an argument around a table.

The agreement concerns the process, not the result.

2. Choose a neutral chair or independent mediator.

3. Include the people directly concerned without turning it into an uncontrolled gathering.

4. Agree that estate property and documents will be preserved.

5. Choose one route for factual updates.

7. Record decisions and significant actions.

8. Keep private estate information off social media.

9. Agree to attempt mediation before hostile court proceedings.

10. Preserve everyone's right to independent legal advice.

11. Allow urgent protective action where genuinely necessary.

12. Write down, circulate and retain the agreed principles.

An early family agreement cannot guarantee that there will be no dispute. It can prevent confusion, reduce suspicion and give everyone a clear route for addressing concerns before positions become entrenched.

The next task is to locate the original will, establish whether it is the latest valid version and identify the executors named in it.
